CBA: May 1st deadline for Career NTTF Notice of Renewal or Nonrenewal

This week we will reach an important deadline in collective bargaining agreement (CBA) implementation.  Article 16 of the CBA established a May 1st deadline for the University to provide notice of renewal or nonrenewal of appointment to all Career NTTF bargaining unit members in the last year of their current appointment, unless their appointments are funding contingent. The requirement to notify does not apply to the classifications of Adjunct NTTF or Acting Assistant Professor.

According to the CBA implementation timeline, deans or designees were to advise Academic Affairs of renewal and non-renewal decisions in April so that the University can meet the deadline.  Should the University fail to meet the deadline in any case, the affected faculty member is entitled to receive a payment proportional to his or her base salary for the number of days the notice is late.

The CBA stipulates that Career NTTF who receive a non-renewal decision “shall be provided a written statement documenting the reasons for non-renewal at the time of notice.” Recommendations to the Provost for non-renewal are required to include a rationale for the decision. It is likely that a case for non-renewal will be based on one of the following reasons:
(a)  Unsatisfactory performance
(b)  Financial considerations
(c)  Diminished programmatic need
(d) Elimination of position, or combining position with another
