CBA Contract: Supervisory Employees and Bargaining Unit Status

The Collective Bargaining Agreement (CBA) defines membership in the United Academics bargaining unit. Consistent with applicable statutory authority, it specifically excludes supervisory employees from the bargaining unit. This fall the University and United Academics reached agreement on a list of faculty members excluded from the bargaining unit based on “supervisory employee” status as of October 1, 2013.

In response to individual faculty inquiries about bargaining unit status, the University initiated a review process of each request to determine whether the faculty member has the required level of supervisory authority to exclude him or her from the bargaining unit.  These determinations have been both time- and fact-intensive. It has become clear to the University and the Union that a more streamlined process is needed, especially in light of the inevitable movement of faculty, such as department heads and principal investigators, in and out of the bargaining unit based on supervisory status. Our goal is to have an improved process in place within the next month. In the interim, the University is waiting to make decisions on the exclusion of additional University faculty from the bargaining unit based on their status as supervisory employees.
